Present Criminal Revision has been filed with the prayer to set aside the impugned order dted 9.1.2019 passed by the Additional Sessions Judge, Aligarh in Criminal Appeal No. 87 of 2018 (Jafar Alam Vs. State of U. P. and another) as well as order dated 8.5.2018 passed by the Additional Chief Judicial Magistrate, Court No. 1, Aligarh in complaint case no. 19 of 2016 (Smt. Gulfasa Vs. Jafar Alam and others), under Section 12, 17, 18, 19, 20, 21, 22 and 23 of Protection of Women from Domestic Violence Act (hereinafter referred to as the Act), Police Station Kotwali, district Aligarh.
Heard learned counsel for the revisionist and learned A.G.A.
Interim maintenance order was granted under Section 23 of the Act by the concerned Magistrate fixing Rs. 1,500/- per month which was challenged by way of appeal by the revisionist. Appeal was dismissed. Thereafter present revision has been filed.
Learned counsel appearing for the revisionist submitted that there is chance of mediation in the matter and to settle the dispute on the basis of mediation.
Having regard to the facts and circumstances of the case, hearing the parties, keeping in view the submissions made by the learned counsel appearing for the revisionist, revision is dismissed at this stage itself with the direction to the revisionist to move proper application before the court concerned within 15 days from today mentioning his willingness about the settlement of dispute on the basis of compromise. If such application is moved, in turn, the Court concerned is hereby directed to refer the matter to the Mediation and Conciliation Centre of the district concerned after obtaining consent of the other side.
In view of the aforesaid, revision is dismissed.
