Heard learned counsel for the applicant.
This petition alleges disobedience of an order dated 18 January 2016 in terms of which an application U/s 482 Cr.P.C. came to be disposed of in the following terms:
"Considering the facts of the case, without expressing any opinion on the merits of the applicant's case, this application U/s 482 Cr.P.C. is finally disposed of with a direction to the Court below to consider and decide the aforesaid Sessions Trial No.48 of 2013 (State Vs. Chandra Kumar and others), arising out of case crime no.1411 of 2011 in accordance with law without granting unnecessary adjournments to either of the parties as expeditiously as possible preferably within a period of six months from the date of production of certified copy of this order, if there is no legal impediment."
From a perusal of the order sheet and as is admitted by the learned counsel for the applicant, the court is at the stage of recordal of statement/evidence of the witnesses. The Court further notes that the learned Judge had only provided that the concerned trial court would not grant any unnecessary adjournments and would endeavour to dispose of the trial with expedition. There is nothing on record to show that this direction has been violated.
Upon a consideration of the aforesaid facts, the Court finds no ground to initiate proceedings in contempt or to hold the opposite party in wilful or deliberate disobedience of the order of the Court.
The petition is dismissed.
