JUDGMENT / ORDER

Petitioner/Accused AND The State of A.P., Through Station House Officer, Jainoor Police Station, Adilabad District, Rep., by its Public Prosecutor, High Court, Hyderabad . Respondent/Complainant Petition under Sections 437 & 439 of Cr.P.C., praying that in the circumstances stated in the petition and the grounds filed herein, the High Court may be pleased to enlarge the petitioner / Accused on bail who is in jail in connection with Cr.No.5/2014 on the file of the Police, P.S., Jainoor, Adilabad District on such terms and conditions.
The petition coming on for hearing, upon perusing the petition and the grounds filed herein and upon hearing the arguments of Sri S.Surender Reddy, Advocate for the Petitioner and of the Public Prosecutor for the Respondent, the Court made the following.
ORDER:
“The petitioner is the sole accused. He seeks for grant of bail. He allegedly committed offences under Sections 302, 201 and 506 read with Section 34 IPC.
The petitioner has been in jail since 28.2.2014. The learned counsel for the petitioner submitted that the alleged incident occurred on 7.12.2013 whereas the FIR was laid on 4.2.2014. He further submitted that in an earlier complaint by the wife of the deceased against the allegation of the petitioner herein, the wife of the deceased inter alia stated that the deceased died owing to heart attack.
The learned counsel for the petitioner submitted that there are differences between the petitioner and the family of the deceased and that this case was foisted against the petitioner on account of animosity.
It would appear that as many as 27 witnesses have already been examined by the investigating agency. In view of the stage of the investigation and in view of the delayed FIR, I consider it appropriate to enlarge the petitioner on bail.
Accordingly, this Criminal Petition is allowed. The petitioner is enlarged on bail on a personal bond of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties in a likesum to the satisfaction of the learned Judicial Magistrate of First Class, Utnoor.”
