Heard learned counsel for the petitioner; Shri Manoj Kumar Yadav, learned counsel for the Gaon Sabha-respondent no. 7 and learned Standing Counsel for the State-respondents no. 1 to 6.
By means of this writ petition the petitioner has come to this Court seeking a direction to restrain the private respondents from opening their drain and flowing it in a pond, which is causing foul smell.
For the said purpose the Writ Court is not an appropriate forum. If any nuisance is being created, the petitioner may file an application under Section 133 Cr.P.C.
The writ petition is misconceived and it is, accordingly, dismissed.
