JUDGMENT / ORDER

When the application came up for hearing today, the learned Standing Counsel for the Central Bureau of Investigation, Sri.Chandrasekhara Pillai submitted that so far he has not been arrayed as an accused in Crime No. RC 4(S) 2012CBI/SCB/TVPM of the Central Bureau of Investigation, Thiruvananthapuram. But his presence is required for interrogation. The counsel for the petitioner submitted that he has been summoned forty times and whenever he appeared, he was manhandled by them. This allegations were denied by the Standing Counsel for the Central Bureau of Investigation. Since, he has not been made an accused in the case so far, the apprehension of the petitioner is that he is likely to be arrested in connection with the above crime is without any basis. So he is entitled to get the anticipatory bail. But, at the same time, he will have to appear before the Investigating officer whenever his presence is required for interrogation in writing to do so and co-operate with the investigation.
