The petitioner had earlier filed a writ petition being no. 25321 of 2018 which was filed for quashing the FIR registered as Case Crime No. 63 of 2018, U/s 420, P.S. Pannuganj, District Sonbhadra. The said writ petition was dismissed by another Bench of this Court on 12.9.2018.
The present second writ petition has been filed with the contention that subsequently sections 467, 468, 471 IPC have also been added.
Nevertheless the fact remains that section 420 IPC is still in existence and the first writ petition has already been dismissed, the second writ petition virtually for the same cause of action is not maintainable.
Accordingly, the writ petition is dismissed as not maintainable.
