Heard learned counsel for the petitioner. Ms. Monika Vaish, learned counsel has accepted notice on behalf of respondent no.1, Sri A.K. Saxena appears on behalf of respondent nos.2 & 3 and learned Standing Counsel appears for the respondent nos.4 & 5.
The petitioner has preferred this petition so as to challenge the recovery citation dated 16.10.2018 issued by respondent no.5 for a sum of Rs.7,11,910/- as electricity dues.
The petitioner contends that he is only using domestic electricity connection and he had been paying regular bills, the demand of Rs.7,11,910/- appears to be incorrect and on the face of it is excessive.
The citation issued must be in pursuance to some adjudication or on the basis of electricity bills which may have been raised against the petitioner. The petitioner has not referred to any of the order of assessment or the bills, rather from the petition it appears that some checking was done and probably on that basis some assessment may have been made.
In view of the above, we do not find any illegality in the recovery citation. Accordingly, we dispose of the writ petition with the liberty to the petitioner to approach the Executive Engineer concerned and demand the necessary adjudicating order or the assessment order or the details as to how the amount sought to be recovered has been calculated and demanded from the petitioner. The Executive Engineer would provide the necessary details to him whereupon the petitioner may take legal action as may be advised.
