Heard learned counsel for the applicant and learned AGA.
The present bail application has been filed by the applicant in Case Crime No. 831 of 2014, u/s 302/34 IPC, P.S. Bilsanda, District Pilibhit with the prayer for enlarging him on bail.
Submission is that in the F.I.R. general role of assault was given to four nominated accused including the applicant, however, during investigation, witnesses have stated that fire made by the applicant had hit the deceased.
In view of the consistent version of the eye witness of assigning specific role to the applicant, I do not find it to be a fit case for enlarging the applicant on bail.
The bail application is, accordingly, rejected.
However, the applicant is in jail since 9.8.2014, the trial court is directed to expedite the trial and conclude the same preferably within the period of four months from the date of production of the certified copy of this order before the trial court.
