1. Heard Mr. Kapadia, learned advocate for the applicant.
2. The applicant has taken out present application seeking below mentioned relief/s:-
"11 (A).....
(B) be pleased to fix the early date of final hearing of Special Civil Application No.10851 of 2010 and hear the same finally;
(C)......."
3. The applicant has placed reliance on the below mentioned observations in order dated 18.10.2210 passed in Special Civil application No.10851 of 2010:-
"....
It will be open for the petitioner to apply for preponing of the matter for final hearing"
4. On the facts and relevant details mentioned by the applicant, it appears that the petitioner has taken out Special Civil Application No.10851 of 2010 in 2010 which came to be admitted by order dated 18.10.2010. Several other old and senior matters are pending in the cause list for final hearing and if the request made by the applicant is granted it would amount to allow applicant out of turn hearing.
5. Under the circumstances, the request as prayed for cannot be granted at this stage. However office is directed to take necessary action and list petition in the cause list for final hearing in due course as per its seniority.
With the aforesaid clarifications the application is disposed of.
