(Per : HONOURABLE MR.JUSTICE V. M. SAHAI) We have heard learned Senior Counsel Mr. R.R. Marshal assisted by Mr. Arpit A. Kapadia appearing for the petitioner and Mr. H.S. Munshaw, learned counsel appearing for the respondents.
The relief (c) claimed in these writ petitions is as under :-
"YOUR LORDSHIPS may be pleased to issue declare the levy of Property Tax and other taxed by the Rajkot Municipal Corporation as ultra vires Section - 129, 140 (2) and Section 141B(3) of the BPMC Act, 1949;"
Since the vires of Sections 129, 140(2) and Section 141B(3) of the BPMC Act, 1929 has been challenged, as per the present roster, this petition is required to be heard by a Bench presided by Hon'ble the Acting Chief Justice where such matters are being listed. Hence, office is directed to place these matters before the said Bench after obtaining necessary nomination from Hon'ble the Acting Chief Justice. Interim relief already granted in these three petitions is extended till the next date of listing.
