The learned Principal District Judge, after hearing the parties, passed an order rejecting the plaint. Since this revision has been filed, without exhausting the appeal remedy available for the petitioner under the Act, this matter is posted today under the caption 'for maintainability'.
2. The learned counsel for the petitioner fairly conceded to withdraw this Civil Revision Petition, with liberty to file a fresh application.
3. Therefore, the Civil Revision Petition is dismissed as withdrawn, at the SR stage itself and consequently the revision petitioner is permitted to file an appeal, if so advised, within a period of three weeks from the date of receipt of a copy of this order. No costs. Registry is directed to return the original papers to the learned counsel for the petitioner, after obtaining a copy of the same.
