THE HON’BLE SRI JUSTICE R.KANTHA RAO WRIT PETITION NO.21706 OF 2014 ORDER:
Heard the learned counsel appearing for the petitioner and the learned standing counsel for APSRTC., appearing for the respondents.
This writ petition is filed seeking a writ of mandamus directing the respondents to regularize the services of the petitioner with effect from 1-7-2012 on par with his batch mates with all consequential benefits.
The petitioner is a driver in third respondent depot. In pursuance of the notification issued by the second respondent in the year 2008 for the post of Contract Drivers in Karimnagar Region, the petitioner applied for the post of driver on contract basis and he was selected for the said post along with his batch mates Sri M.Rajender (ID No.930084) E No.323019, Driver KRMR-II Depot and Sri D.Ravi (ID No.930106) E No.323020 in Karimnagar Region. Subsequently, by letter dated 1-
7-2009, the respondents directed the petitioner to report at Ranigunj-I Depot for temporary utilization of his services in Hyderabad City Zone. Accordingly, he worked in Hyderabad City Zone and that on 8-4-2010, he was redirected to Karimnagar Region and accordingly, he reported duty at Godavarikhani on 8-4-2010.
It is submitted by the petitioner that the services of his batch mates were regularized in Karimnagar Region with effect from 1-7-2012, but his serves were not regularized from the aforesaid date along with his batch mates. According to him, he has been working continuously without any break in service from the date of his initial appointment and he is entitled for regularization on par with his batch mates with effect from 1-7-2012. He made a representation to the respondents to regularize his services with effect from 1-7-2012 along with his batch mates and the said representation is pending with the second respondent.
In the aforesaid circumstances, the second respondent is directed to consider the representation of the petitioner for regularization of his services from 1-7-
2012 on par with his batch mates with all consequential benefits and fixation of pay and payment of arrears etc., in accordance with rules, within a period of two months from the date of receipt of a copy of this order.
The writ petition is accordingly disposed of at the stage of admission. No order as to costs. The Miscellaneous Petitions pending if any shall stand closed.
