JUDGMENT / ORDER

HON'BLE SRI JUSTICE C.V.NAGARJUNA REDDY WRIT PETITION No.38316 of 2014 Date:24.12.2014 Between:
J.Sharman, S/o J.Bajya . Petitioner And:
The State of Telangana., reptd by its Principal Secretary, Civil Supplies Department, Hyderabad and four others.
. Respondents Counsel for the Petitioner: Sri T.Rajinikanth Reddy Counsel for the Respondents: AGP for Civil Supplies (AP) The Court made the following:
ORDER:
This Writ Petition is filed for the following substantive relief:
“…. to issue a writ, order or direction, more particularly, writ of Mandamus declaring the orders of respondent No.4, vide proceedings No.E2/2379/2014, dated 29.11.2014, keeping the petitioner’s authorization under suspension for fair price shop No.15 of Jalthanda Village, Peddavoora Mandal, Naglonda District on flimsy and vague allegations as illegal and arbitrary and consequently, to direct the respondents to continue the petitioner as the fair price shop dealer.”
As this Court found that the findings rendered by respondent No.4 are fallacious, the said respondent was directed to be personally present before this Court on 22.12.2014. Accordingly, respondent No.4 was present. After hearing the views expressed by this Court during the hearing, respondent No.4 has assured that he will take corrective steps. Therefore, the case was adjourned to today.
Today, at the hearing, learned Government Pleader for Civil supplies (Telangana State) has submitted that respondent No.4 has issued proceedings, vide Lr.No.E2/2379/2014, dated 23.12.2014, wherein he has restored the petitioner's fair price shop authorization by closing the case.
As this Court perceives that the very initiation of proceedings by respondent No.4 on the allegations, based on which he has suspended the petitioner's fair price shop authorization are misconceived and illegal, he is cautioned to be careful in future. As respondent No.4 has restored the petitioner's fair price shop authorization and dropped further action against him, the Writ Petition is closed.
As a sequel to closure of the Writ Petition, WPMP.No.47946 of 2014 filed by the petitioner for interim relief is disposed of as infructuous.
