1. Heard Sri Sudhir Dixit, learned counsel for the applicant and Sri Dharmendra Singh Chauhan, learned counsel for the opposite parties.
2. On the last date, learned counsel for the opposite parties has pointed out that during pendency of the present application, the opposite parties had appointed an arbitrator vide communication dated 16.09.2019. The applicant consented to that appointment and appeared before that arbitrator. The proceedings are thus stated to be pending without any objection as to jurisdiction being raised by the applicant. Upon such proceedings, learned counsel for the applicant had taken time to obtain fresh instructions.
3. Today, upon instructions, Sri Sudhir Dixit, learned counsel for the applicant states in view of the aforesaid development, he does not wish to press the present application as it has become infructuous and it may be dismissed as such.
4. Accordingly, the present application is dismissed as infructuous.
