This petition has been filed for transferring Motor Accident Case No. 112 of 2015 pending before Motor Accident Claims Tribunal, Gautambudh Nagar. It is stated that various other claims in respect of same accident have been instituted at Bulandshahar and, therefore, all the proceedings be heard together.
Law is settled that a claim would be maintainable where the claimants resides. Admittedly, the claimants are shown to be resident of Gautambudh Nagar. There would be no justification for this Court to direct the proceedings to be transferred to Bulandshahar in exercise of power under Article 226 of the Constitution of India.
Writ petition lacks merit and is accordingly dismissed.
