M/S J P Construction vs State Of U P And Others

High Court Of Judicature at Allahabad|30 July, 2018

JUDGMENT / ORDER

Court No. - 38
Case :- WRIT - C No. - 24785 of 2018 Petitioner :- M/S J .P Construction Respondent :- State Of U P And 2 Others Counsel for Petitioner :- Vinod Kumar Yadav,Shashank Kumar Counsel for Respondent :- C.S.C.
Hon'ble Abhinava Upadhya,J. Hon'ble Shashi Kant,J.
By means of this petition the petitioner has come up to this Court for challenging the order dated 18.1.2018.
Why this writ petition is being filed in such a delay has not been indicated, that apart the petitioner had executed some work for Rural Engineering Department, Ballia in the year 2008. The bill etc. were not paid and therefore, the petitioner earlier filed a writ petition being Writ-C No. 58665 of 2017, which was disposed of vide order dated 8.12.2017 with a direction to the authorities to consider the claim of the petitioner.
Now, an order has been passed stating therein that the petitioner's payment has not been made, as there was serious discrepancy in the work of the petitioner and was also not found satisfactory.
If the petitioner has done any work for the department and payments were not made, the petitioner could have invoked arbitration clause, if any.
No ground has been made out for quashing the order, which clearly recites that the payment has not been made on account of the fact that work of the petitioner was not satisfactory.
The writ petition has no merits and is liable to be dismissed.
The writ petition is, accordingly, dismissed.
Order Date :- 30.7.2018 A. Pt. Singh (Shashi Kant, J.) (Abhinava Upadhya,J.)
