For Petitioner : Mr.G.Krishnakumar O R D E R The plaintiff in O.S.No.13524 of 2010 (originally numbered as C.S.No.387/2005) on the file of VII Additional Judge, City Civil Court, Chennai, has filed the above Civil Revision Petition to direct the Trial Court to dispose of the suit, within a time frame.
2. The plaintiff filed the suit in O.S.No.13524 of 2010 for declaration and permanent injunction. The defendant filed their written statement and are contesting the suit.
3. The suit was filed as early as in the year 2005 and the written statement was also filed in March 2006. Subsequently, the suit was transferred to the file of City Civil Court, Chennai, in the year 2010 and the suit is kept pending till this date.
4. The learned counsel appearing for the revision petitioner submitted that though the suit was filed more than 10 years ago, the Trial Court has not yet disposed of the same, which caused hardship and prejudice to the plaintiff.
5. Having regard to the submissions made by the learned counsel appearing for the petitioner and also taking into consideration the limited prayer sought for in the Civil Revision Petition, without expressing any opinion with regard to the merits of the case, I direct the VII Additional Judge, City Civil Court, Chennai, to dispose of the suit in O.S.No.13524 of 2010, on merits and in accordance with law, within a period of four months from the date of receipt of a copy of this order.
With this observation, the Civil Revision Petition is disposed of.
No costs.
