Respondents (By Sri Ashwin S Halady, Advocate for R1; Sri.G.Narsi Reddy, Advocate for R2) This Writ Petition is filed under Articles 226 and 227 of the Constitution of India, praying to direct the R1 to issue the khata certificate and khata extract for the schedule property to the petitioner.
This Writ Petition coming on for ‘Orders’ this day, the Court made the following:
ORDER The petitioner has been allotted industrial site by the second respondent and has made representation seeking for transfer of ‘khata’ into the petitioner’s name, to the first respondent.
2. The respondent – BBMP had insisted that the petitioner obtain a ‘no objection certificate’ from the second respondent.
3. It is submitted that the necessary `no objection certificate’ has been obtained from the second respondent and has been furnished to the first respondent.
4. In the light of such development, the counsel appearing for respondent No.1 states that the representation of the petitioner will be considered and disposed of, in accordance with law, within a period not later than eight weeks on receipt of certified copy of the order. It is further directed that the petitioner is to submit fresh representation within one week from today to the respondent No.1 with necessary details. The fresh representation would supplement the earlier representation. While considering such application for effecting ‘khata’, the first respondent is at liberty to call upon the petitioner to furnish such documents, as may be required, for disposal of the application of the petitioner.
Accordingly, taking note of the above, petition is disposed of.
