It appears that the first respondent - Pollution Control Board has taken action in the matter and a notice has been given to the unofficial respondent. However, we feel that no final order has been passed whether the unofficial respondent has contravened the provisions of law or not.
We, therefore, direct the Pollution Control Board to take a decision finally on this issue serving notice upon the petitioner as well as the unofficial respondent and pass appropriate order in accordance with law within a period of three weeks from the date of receipt of a copy of this order. The second respondent municipal authority shall also look into the complaint of the petitioner made against the unofficial respondent and take a decision in the matter as directed to the Pollution Control Board within the same time.
With the above directions, the writ petition is disposed of. There will be no order as to costs.
Consequently, W.P.M.P. No.12681 of 2014 filed by the petitioner for interim relief shall stand closed.
