Order on Modification Application :-
Heard Sri Ashok Nath Tripahti, learned counsel for the applicants and Sri Rajiv Lochan Shukla, learned counsel for the informant/opposite party no.2.
By way of the instant application, the learned counsel for the applicant has sought for modification of the order dated 23.07.2021 which is extracted hereinbelow:-
"As prayed, put up this case on 31th August, 2021, as fresh."
Learned counsel for both the parties unanimously urged that any date may be fixed in the first week of August, 2021 as the argument extended and concluded and file was kept for passing order by co-ordinate Bench of this Court. However, it was listed before this Court on 23.07.2021, which was not required to be listed before this Court.
Considered the submissions.
The order dated 23.07.2021 is modified to the extent that the date fixed earlier i.e. 31st August, 2021 is changed to 5th August, 2021.
Put up this case on 5th August, 2021 as fresh before the appropriate Bench.
Accordingly, the modification application is allowed.
