Heard Shri Navin Sinha, learned Senior Counsel assisted by Shri Raghav Nayar and Kalpana Sinha, learned counsel for the petitioner and Shri Hemant Kumar, learned counsel for the respondents.
It is the contention of the petitioner that a fresh rate list has been issued by the respondents and they have invited objections to the fresh rate list which has not been finalised as yet and despite that they have made an assessment against the petitioner on the basis of earlier rate list, which had been quashed by this Court in a Writ Tax No. 831 of 2015 dated 22.08.2016.
Shri Hemant Kumar, learned counsel for the respondents may file a counter affidavit within a month.
List this matter on 03.05.2018.
Subject to deposit of 50 per cent of the demand so raised and deposit a security for the rest in the shape of security other than cash or bank guarantee or in the alternative he may accept an indemnity bond, no coercive measures shall be taken against the petitioner till 03.05.2018.
In case, the petitioner had made any previous deposit, the same may be adjusted subject to verification by the respondents.
