Sri K.R. Singh learned counsel has put in appearance on behalf of the respondent-development authority.
By means of the present petition, the petitioner seeks to challenge the notice dated 05.01.2021 issued by the Secretary, Gorakhpur Development Authority under Section 26-A (4) of the U.P. Urban Planning and Development Act' 1973.
In none of the paragraph of the writ petition, the petitioner had submitted that he has given reply to the said notice. The challenge to the notice, therefore, is found premature. The writ petition is disposed of with the observation as follows:-
1. The petitioner shall submit a reply to the show cause notice dated 05.1.2021, if not already submitted within a period of three weeks from today.
2. On the receipt of the said reply, the competent authority shall pass a reasoned and speaking order in accordance with law dealing with all points of objection.
