A pond situate in Plot No.317-Kha was auctioned and the petitioner's bid of Rs.73,000/-, which was the last bid, was not approved. The petitioner filed a writ petition being Writ Petition No.36208 of 2018. This writ petition is, even today, pending. During the pendency of the writ petition, one Smt. Lakhpati Devi filed a Writ Petition No.13547 of 2018 which was disposed of on 2.5.2018 with a direction for holding a fresh auction. In pursuance of the order dated 2.5.2018 passed in Writ Petition No.13547 of 2018, the auction proceedings have been advertised by the impugned advertisement dated 17.7.2018.
Learned counsel for the petitioner has submitted that since his writ petition was pending and his right was yet to be adjudicated, further proceedings in pursuance of the impugned advertisement could not take place.
Since there was a direction of this Court dated 2.5.2018, I do not think it proper to interfere with the further proceedings pursuant to the advertisement dated 17.7.2018.
The writ petition is, accordingly, dismissed.
Needless to say that the proceedings which would take place in pursuance of the impugned advertisement dated 17.7.2018, shall be bound by the result of the Writ Petition No.36208 of 2018.
