The contention of the petitioner is that the order impugned in the writ petition has been passed without any application of mind. His further contention is that thrice time earlier, the authority concerned had refused to grant sanction.
The matter needs consideration after exchange of affidavits.
Learned A.G.A. has accepted notice on behalf of respondent nos. 1 to 8.
Issue notice to respondent no. 9 returnable at an early date. Steps be taken within a week.
All the respondents may file counter affidavit within four weeks. Petitioner will have three weeks thereafter to file rejoinder affidavit.
Till further orders of this Court, the petitioner shall not be arrested in Case Crime No. 410 of 2009, under Sections 409, 467, 468, 471, 120-B IPC and Section 7/13 P.C. Act, 1988, P.S.
Gagaha, District Gorakhpur. However the investigation will go on and the petitioner will participate and cooperate with the investigation.
