Civil Misc. Impleadment Application No.NIL of 2019:
Heard learned counsel for the parties. The application is allowed. Let Bhola Rai be impleaded as respondent no.3 in the array of parties during the course of the day.
Order on the petition:
Rejoinder affidavit filed today be kept on record.
When the petitioner intended the demarcation of plot no.3028, the respondent, who had sought impleadment as respondent no.3 brought to the notice of the Court that with regard to a neighbouring plot bearing No.3029-K, an application had been filed for correction of map and since by the correction of map, there was a possibility that the plot no.3028 would also get affected, an order of status-quo was directed by the Authority seized with the case being Case No.D-201705440002810. He also brought to the notice of the Court the order dated 20.12.2017 in which status-quo with regard to plot no.3028 was also directed to be maintained.
Under such circumstances, it is being directed that the Case No.D-201705440002810 which had been filed for the correction of map be decided within a period of one month from the date of presentation of a certified copy of this order, if there is no other legal impediment. It is further directed that the demarcation proceedings initiated by the petitioner shall be taken up and concluded within a period of one month thereafter.
It would always be open for the petitioner, to bring to the notice of the Authority, seized with Case No.D-201705440002810 under section 30 of the U.P. Revenue Code, 2006 that repeated applications were being filed. However, the submissions of the parties, shall be considered on their own merits.
With the aforesaid observations, the writ petition is disposed of.
