Heard learned counsel for the petitioner and Ms. Ghazala Bano Quadri, counsel for the respondents.
Sole prayer of the petitioner is that the Case No. 38 of 2010-11 under Section 33/39 of the U.P.Z.A. & L.R. Act, pending before Up-ziladhikar, Handia, District Allahabad, be decided within a stipulated period of time.
Learned counsel for the caveator has submitted that four times earlier the case was decided and every time the petitioner got the orders recalled and therefore, prays that now when the proceedings are undertaken the petitioner who is a defendant/opposite party in the case should be always present on all dates so that the case is decided in the presence of both the sides.
Under such circumstances it is, therefore, directed that the Case No. 38 of 2010-11 under Section 33/39 of the U.P.Z.A. & L.R. Act be decided within three months from the presentation of a certified copy of this order.
However, if the opposite party in the case takes any adjournment, cost should be imposed.
The writ petition is disposed of.
