JUDGMENT / ORDER

Hon'ble Manish Mathur,J.
Case is taken up through video conferencing.
Issue notice to opposite party No.5.
Writ petition has been filed seeking following reliefs:-
"[i] issue a writ order or direction in the nature of Mandamus commanding the opp. Parties to conduct an enquiry in respect of financial illegalities and irregularities committed by the opp. party no.4/5 and take necessary legal action against her.
[ii] issue a writ order or direction in the nature of Mandamus commanding the opp. Parties to decide the representation dated 13.4.2021 as contained in ANNEXURE No.1 to this writ petition expeditiously by a speaking and reasoned order."
Mr. Pankaj Gupta appearing for opposite party No.4 has raised an objection regarding maintainability of the writ petition on the ground that under Section 27 of U.P. Panchayat Raj Act, petitioner has a remedy of filing complaint against a former Gram Pradhan. The petitioner has not availed such remedy, as such, the writ petition in the given facts and circumstances is not maintainable.
We are satisfied that the petitioner has a statutory remedy which he has not availed, as such, there is no reason to grant such indulgence in this writ petition at this stage.
The writ petition is accordingly dismissed however with liberty to the petitioner to go and avail the statutory remedy available to him under law.
