Apropos the order passed by this Court on 27.02.2012 which is reproduced as under;
"1.Learned advocate Shri Prabhav A.Mehta once again requested for time to advert to the query with regard to the applicability of Section 23C of the MMDR' 1957. At his request matter is kept on 28.02.2012.
2.After passing of this order, Shri Mehta made alternative submission with regard to equal treatment qua others, therefore, without insisting upon writ of prohibition the petitioner may be satisfied only if he is being treated with others that is the submission.
3. In view of this, the matter is required to be adjourned so as to enable the learned AGP to obtain instruction in this regard."
Learned AGP submitted that he is unable to receive specific instructions qua similarity claimed by the petitioner qua others mentioned in the statement.
The Collector of the District in consultation with the concerned geologist, even if he is incharge, shall file an affidavit apropos the claim and similar treatment qua others mentioned in the amendment. The said affidavit shall be filed on or before 05.03.2012. Hence S.O. to 05.03.2012.
