The petitioner is the holder of Indian Passport bearing No.E.8339489 issued by the second respondent. The validity of the above Passport expired on 17.3.2014. The petitioner submits that by mistake his date of birth is shown in the Passport as 28.3.1970. In fact, according to the petitioner, actual date of birth of the petitioner is 15.8.1975. The petitioner submits that the Passport Authority is refusing to entertain application to correct the Passport for the reason that the disparity of the age is more than two years. Accordingly, the petitioner has approached this Court.
2. Admittedly, the petitioner's validity of the Passport is expired. This Court in series of writ petitions held that the Passport Issuing Authorities have power to correct the date of W.P.(C) No.25043 of 2014 2 birth in the Passport even if the difference is beyond two years. This Court stuck down the circular restricting the power of the Passport Issuing Authorities to exercise correction only up to the difference in less than two years.
In view of the above, the petitioner shall approach the Passport Issuing Authorities with an application for Passport and also an affidavit stating the reasons for showing the wrong details in the earlier Passport. The Passport Authorities on being satisfied with the genuineness of the claim, shall issue new Passport showing the date of birth of the petitioner as claimed by him in accordance with law. Needful shall be done within a period of two months. The petitioner shall produce a copy of this judgment and the writ petition before the respondents for compliance.
The writ petition is disposed of as above.
