Sri Ram Raj Pandey, learned counsel for the petitioner and Sri Deepak Mishra, learned A.G.A. for the State are present.
This Writ Petition has been filed with a prayer to quash the impugned F.I.R. dated 30.05.2018 lodged by respondent no.3 bearing Case Crime No. 725 of 2018, under Sections 147, 323, 504, 506, 452, 376 and 511 I.P.C., P.S. Baghpat, District Baghpat. Simultaneously a further prayer is also made to not arrest or harass the petitioner.
Learned counsel for the petitioner submitted that the respondent No.3 is a lady of easy virtues and lodged several complaints against various persons in which in some of them, final report were submitted and some of them have been dismissed, the said fact is mentioned from para Nos. 7 to 12 of the petition. The present F.I.R. has been lodged against the petitioner only for harassment. Learned counsel further pointed out that the version of respondent given in F.I.R. is contrary to the statement recorded under Section 164 Cr.P.C.
Learned A.G.A. opposed the prayer of quashing and submitted that victim has sustained injury on her person.
After having heard learned counsel for the parties present and perused the impugned FIR as well as the other material brought on record, we are not inclined to interfere with the matter.
The petition lacks merit and is accordingly, dismissed.
