The order impugned dated 31.5.2013 is stated to have been passed under Section 5 of the U.P. Public Premises (Eviction of Unauthorised Occupants) Act, 1972, directing the petitioner to remove unauthorised construction raised over the land of Nagar Palika Parishad, Kairana.
Against an order passed for eviction of unauthorised occupant under Section 5, an appeal lies under Section 9 of the same Act. Therefore, this Court is not inclined to entertain the petition and also in view of the fact that the order impugned was passed more than six years back.
The petition is disposed of with liberty to the petitioner to avail the alternative remedy, if so advised.
