This Miscellaneous Civil Application No. 737 of 2012 is notified today with office note dated 23.4.2012. It is pointed out in the office note that the registry had received the explanation dated 18.4.2012 from the learned Principal Judge, City Civil Court, Ahmedabad was in Special Civil Application No. 1446 of 2012 instead of present application i.e. Miscellaneous Civil Application No. 737 of 2012 and since the aforesaid Special Civil Application was already disposed of, explanation received was sent to the decree department by the Judicial Administrative Branch on 19.4.2012. Since the attention as regards aforesaid facts was drawn by the office today, the office was permitted to notify this application today for passing appropriate orders.
Considering the fact that the explanation of the learned Principal Judge, City Civil Court, Ahmedabad was received on 18.4.2012, since because of the facts stated in the note, same could not be brought to the notice of this Court, this Court had to pass order dated 20.4.2012 directing the Registrar, City Civil Court, Ahmedabad to remain personally present before this Court on 27.4.2012 at 2.30 p.m. However, now, since the office has drawn attention of this Court about receipt of explanation from the learned Principal Judge, City Civil Court, Ahmedabad, order of this Court dated 20.4.2012 is required to be recalled. It is hereby recalled. Registry shall accordingly intimate the Registrar, City Civil Court, Ahmedabad about recalling of order dated 20.4.2012 and shall inform him that he shall now not be required to remain present on 27.4.2012. Registry shall communicate this order to the Registrar, City Civil Court, Ahmedabad latest by 24.4.2012. Present application being Miscellaneous Civil Application No. 737 of 2012 shall now be notified before this Court on 27.4.2012 for passing further orders.
