Court No. - 58
Case :- WRIT - A No. - 15844 of 2018 Petitioner :- Ishwari Prasad Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Shive Datta Yadav Counsel for Respondent :- C.S.C.
Hon'ble Ashwani Kumar Mishra,J.
Petitioner's son was a Tube-well Operator, who has died on 7.9.2017. His grievance is that respondent no.4 was not married to petitioner's son, and therefore, her claim for appointment on compassionate ground was not liable to be considered. Certain recommendations made in favour of respondent no.4 have, therefore, been impugned in this petition.
Learned Standing Counsel states that all such issues of fact shall be examined by the competent authority, at the first instance.
In the facts and circumstances, this writ petition stands disposed of by observing that respondent no.3 shall accord consideration to petitioner's objection before proceeding to take a final decision in the matter relating to grant of compassionate appointment to respondent no.4, in accordance with law, after affording an opportunity of hearing to the respondent no.4.
