JUDGMENT / ORDER

1. Leave to amend the cause-title, is granted. The necessary amendment may be carried out forthwith.
2. This petition, under Article 226 of the Constitution of India, has been filed with a prayer to direct the Secretary (Appeals), Revenue Department, to hear and decide Revision Application No.36 of 2010, as expeditiously as possible.
3. Heard Mr.Kirit R. Chaudhari, learned advocate for the petitioners, and perused the averments made in the petition. It is submitted by the learned advocate for the petitioners that petitioner No.1 is a senior citizen, aged 74 years. The Revision Application filed by the petitioners against the orders of the Revenue Authorities is pending before the Secretary (Appeals). As petitioner No.1 is aged 74 years and is not keeping good health, the petitioners have submitted an application dated 20.10.2011 for early hearing of the Revision Application to the Secretary (Appeals), Revenue Department, that has not yet been heard and decided. It is submitted by the learned advocate for the petitioners that the interest of justice would be met, if the Secretary (Appeals), Revenue Department is directed to consider and decide the application dated 20.10.2011 filed by the petitioners for early hearing of the Revision Application.
4. In view of the submissions made by the learned advocate for the petitioners, and on the facts and in the circumstances of the case, the following order is passed:
The Secretary (Appeals) (respondent No.5) is directed to consider and decide the application dated 20.10.2011 filed by the petitioners for early hearing of Revision Application No.36 of 2010, in accordance with law and as expeditiously as possible, keeping in mind the aspect that petitioner No.1 is a senior citizen and is stated to be not keeping good health.
5. The petition is disposed of, in the above terms, without entering into the merits of the case.
Direct Service of this order, is permitted.
