JUDGMENT / ORDER

Mr.
Nandish Y. Chudgar, learned advocate for Nanavati Associates tenders communication dated 9.1.2012 and 18.1.2012. Both the communications are taken on record. Mr. Chudgar submits that in view of the fact that the inquiry is already over, the present petition has become infructuous. Mr. Chudgar further submits that in view of the earlier order dated 28.12.2011, the authorities have clarified that the respondents have exercised power conferred by Regulation 7(1) of the Regulations of Bank of India Officer Employees (Discipline & Appeal) Regulations, 1976 instead of Regulation 6(2) of the said regulations.
In view of the above statement, the petition has become infructuous and the same is disposed of accordingly. Notice discharged. However, it would be open for the petitioner to resort to the appropriate proceedings in accordance with law and the regulations.
