Heard learned counsel for the petitioners and learned A.G.A. for the State respondents.
The present writ petition has been filed with the prayer to quash the First Information Report dated 07.7.2021 registered as Case Crime No.456 of 2021 under Sections 323, 504, 342, 506 IPC, 3(1) (r), 3 (1) (s) and 3 (2) (va) of S.C./S.T. (Prevention of Atrocities Act) 1989 (Amended in 2015) Police Station Khaleelabad, District Sant Kabir Nagar. Further prayer has been made not to arrest the petitioners in the aforesaid case.
Mrs. Archna Singh, learned A.G.A-I, states that the petitioner no.1 has been exonerated in the aforesaid case crime and chargesheet has been submitted before the competent court against petitioner nos.2, 3, and 4. As such, the cause of filing the writ petition no more survives and the writ petition is liable to be dismissed as infructuous.
In view of the above, the writ petition is dismissed as infructuous with liberty to apply for bail as permissible under law and in accordance with law.
