Heard learned counsel for the petitioner, learned counsel for Nagar Palika Parishad and the learned Standing Counsel for the State-respondents.
Present petition has been filed beseeching early disposal of Revision No. 341/M of 2015, Computerized No. C201615000048 (Ishwar Chand vs. Saluhuddin & Others) filed under Section 219 of the U.P. Land Revenue Act, 1901 pending before the Additional Commissioner (Judicial), Azamgarh Division, Azamgarh (Respondent no. 1).
It is submitted by the learned counsel for the petitioner that against the order dated 03.11.2015 passed by the Tehsildar in a mutation proceeding under Section 34 of the U.P. Land Revenue Act, the petitioner has filed a revision dated 21.12.2015 which is pending protracted. The opposite parties have already appeared in the matter and the revision is ready for final adjudication.
Learned Standing Counsel as well as counsel for Nagar Palika Parishad have no objection, if a direction is issued to decide the aforesaid revision, expeditiously.
In this conspectus as above, no useful purpose would be served to keep this matter pending. Therefore, this court deems it appropriate to finally dispose of the present writ petition, without making any observation on the merits of the case, as mentioned in the writ petition, with a direction to respondent no. 1 to decide the aforesaid revision, strictly in accordance with law by means of a reasoned and speaking order, after affording opportunity of hearing to the parties concerned and without granting any unnecessary adjournments to either of the parties expeditiously, preferably within a period of three months from the date of production of certified copy of this order.
With the aforesaid direction, this petition is finally disposed of.
