Heard Sri Dhananjay Kumar Mishra, learned counsel for the applicant and learned A.G.A. for the State and perused the material placed on the record.
Applicant-Ishtiyaq Kankali @ Ninhe @ Nanhe seeks bail in Case Crime No.693 of 2017, under Sections 308, 323, 364, 376-D and 377 I.P.C., Police Station Sarpatahan, District Jaunpur.
Having heard learned counsel for the parties and perused the record, I find that it is a case of gang-rape by five accused who could not be known at the time of lodging of the F.I.R. During investigation, all the accused including the accused were arrested in the vehicle and they were put up for identification test. The prosecutrix correctly identified the applicant and other co-accused in jail.
In the facts and circumstances of the case,I do not find any ground to consider the prayer for bail of the applicant. The prayer for bail is declined at this stage.
The application for bail is, hereby, rejected without expressing any opinion on the merit of the case.
