The petitioner's Writ Petition No.1063 (SS) of 2013 was finally disposed of by the Writ Court vide judgement and order dated 8.2.2018 in following terms :-
"Learned counsel for petitioners prays that he may be permitted to withdraw the present writ petition with liberty to approach the respondent No.2, District Judge, Unnao, by a representation for fixation of his salary in accordance with Rules applicable and the Government orders/directions issued from time to time. He further submits that as per Service Rules, he is also entitled for promotion which may be considered for promotion.
With the aforesaid liberty, the petition is consigned to records. In case, representation is moved by the petitioner along with a certified copy of this order, it is expected that the District Judge, Unnao shall consider and decide the same in accordance with law and Rules applicable to the case of the petitioner, if possible, within a period of three months from the date a certified copy of this order is received. It is made clear that this Court has not gone into the merit of the case. All questions are open for the opposite party No. to decide in accordance with law.
The writ petition is disposed of."
In pursuance to the notice issued in this contempt petition, a compliance affidavit of Mr. Akhilesh Kumar Tiwari, the then District Judge, Unnao has been filed. Along with the aforesaid affidavit, a copy of the decision dated 11.3.2019 has been placed on record as Annexure No.A-3, whereby the petitioner's case has been rejected against his reversion.
In view of the aforesaid decision dated 11.3.2019 taken in the case of the petitioner, nothing survives in the present contempt petition, which is hereby dismissed as having become infructuous.
However, if the petitioner is aggrieved by the aforesaid decision dated 11.3.2019 taken in his case, he may approach the competent Court/forum, if he is so advised and law permits.
Contempt notice stands discharged.
