Petitioners have preferred the present petition inter-alia with the prayer to set-aside the order dated 20.03.2021 passed by the Civil Judge (Senior Division), Jaunpur in Original Suit No.1/2015 (Amrunnisha Vs. Saleem and others).
It is argued by the counsel for the petitioners that respondent no. 1 namely Amrunnisha filed a Civil Suit in the court of Civil Judge (Senior Division), Jaunpur being Original Suit No.1 of 2015. It is argued that application along-with Original Suit for grant of interim injunction was also filed. It is further argued that the petitioners/defendants in the suit are in possession.
After some arguments, counsel for the petitioners confined his prayer only to the effect to direct the court below to pass appropriate order on the application filed in the Suit being application 6-C.
Without interfering with the order passed by the court below which is under challenged in the present petition, the present petition is disposed of finally with a direction to the court below to consider and decide the aforesaid application in accordance with law expeditiously but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties, if there is no legal impediment.
