Heard learned counsel for the petitioner and the learned Standing counsel for the respondents. Sri Kunal Ravi Singh has appeared for the Chief Information Commissioner.
The Chief Information Commissioner of the State of U.P. vide order dated 26.2.2018 directed the U.P. Public Service Commission to allow inspection of the answer books of the Provincial Civil Services (Judicial) 2016 to the petitioner as demanded by him vide his application dated 23.9.2017. The said order was not complied with by the Commission and therefore on 24.4.2018 the Chief Information Commissioner had passed an order imposing penalty of Rs. 25,000/- upon the Commission but even then neither the penalty has been deposited nor the copies have been shown to the petitioner.
Learned counsel for the petitioner submits that he has no other alternative remedy but to approach this Court for a direction that the copies may be shown to him as directed by the Chief Information Commissioner. Sri M.N. Singh, learned counsel for the U.P. Public Service Commission states that the above orders are under challenge by the Commission in a writ petition and he admits that there is no interim order operating therein.
In view of the above, as the above orders of the Chief Information Commissioner stands whether right or wrong the Commission is bound to comply with the direction therein. At this stage Sri M.N. Singh submits that the petitioner may attend the office of the U.P. Public Service Commission on any working day and the necessary copies would be shown to him.
In view of the above, we direct the petitioner to appear in the office of the Secretary, U.P. Public Service Commission on 6th of August 2018 during the working hours whereupon the U.P. Public Service Commission will ensure that the copies are shown to him as directed vide order dated 26.2.2018 passed by the Chief Information Commissioner of the State of U.P.
The petition is disposed of.
