Earlier while this writ petition was entertained, it appears some mediation was proposed and accordingly this Court passed order directing the parties for mediation under order dated 10.07.2009. The report of the Mediation and Conciliation Centre of this Court is on record, according to which the mediation between the parties has failed.
Learned counsel appearing for the respondent no. 1 states that against the order passed by Chairman dated 10.02.2019 impugned in the present writ petition the petitioner has an alternative efficacious remedy of revision before the State Government under Section 12 of U.P. Industrial Area Development Act, 1976 read with Section 41(3) of U.P. Urban Planning and Development Act, 1973.
In view of the above, we are disposing off this writ petition with a direction to the petitioners to approach the authority in revision provided under the relevant statute and it is hereby further provided that in the event petitioners prefer revision petition before the competent authority under the aforesaid sections within a period of four weeks from today along with certified copy of this order, the same shall be heard and decided on merits in accordance with law within a period of three months from the date of its presentation.
The writ petition is disposed of with the aforesaid observations and directions.
