Heard learned counsel for the applicant and learned A.G.A. for the State and perused the record.
Learned counsel for the applicant contended that applicant was not member of Zila Panchayat but his wife contested the election of Zila Panchayat who succeeded, defeating one Premwatri. On the basis of false allegation, the applicant was implicated in the present case. There was no evidence, regarding the payment of such amount. for allotment of house under the Indira Vikas yojna. However, the applicant is in jail since 27.5.2010.
In this view of the matter, without expressing any opinion on merits of the case, let the applicant namely, Ishakh Ali @ Ishak Khan be released on bail in Case Crime No. 101 of 2008, under sections 406 and 504 I.P.C., P.S. Indargarh, District Kannauj on his furnishing a personal bond with two sureties each in the like amount to the satisfaction of the Court concerned Order Date :- 21.6.2010 S.A.A.Rizvi
