This Court in Crl. Misc. Application No. 13751 of 2018 vide order dated 25.5.2018 had stayed the arrest of the petitioner till submission of chargesheet or in the event victim made appropriate statement before the Court absolving him from the charges as alleged in the first information report.
Learned counsel for the applicant brought on record the statement recorded under Section 164 Cr.P.C. of the victim and alleges that still police is unnecessarily harassing him.
Learned counsel for the applicant to serve copy of the contempt application to the learned Additional Chief Standing Counsel Sri P.K.Giri, who shall seek instructions in the matter as to why police is still harassing the petitioner inspite of statement under Section 164 Cr.P.C. got recorded by the victim on 13.06.2018.
Let matter may be placed on 27.09.2018 as fresh.
It is made clear that leaned Additional Chief Standing Counsel shall instruct the authority concerned that in the event statement as has been filed alongwith affidavit is found to be correct and true, the order of writ Court shall be complied with in its letter and spirit.
