1. Rule. Learned APP Mr. H.L.Jani waives service of Rule for Respondent No.1-State of Gujarat.

The present Criminal Miscellaneous Application has been filed by the Applicant under Section 482 of the Code of Criminal Procedure for the prayer as stated in the memo of Application inter alia providing the protection to the Applicant and his wife and also for direction that Respondent No.3-DSP Kheda at Nadiad may be directed to decide the representation of the Applicant at Annexure-C.
3. Heard learned Advocate Mr. Shakeel A. Qureshi for the Applicant and learned APP Mr. H.L.Jani for the Respondent State.
4. In view of the judgment of the Hon'ble Apex Court in case of Lata Singh v. State of U.P. & Anr., AIR 2006 SC 2522, the CR.MA/12099/2012 2/2 ORDER interest of justice would be served if the alternate prayer regarding direction to Respondent No.3-DSP Kheda at Nadiad to decide the representation at Annexure-C is given. Therefore Respondent No.3-DSP Kheda at Nadiad is directed to take into consideration all the relevant papers and decide the representation within a period of two weeks, which according to the Applicant is sent on 7th August, 2012. The same should be considered in accordance with law.
5. The matter is ordered to be placed on board on 14th September, 2012. DS permitted.
