Petitioner has approached this Court seeking a mandamus to command the respondents to provide security to the petitioner.
The aforesaid relief is being claimed in the background of the fact that in 2015, an incident of murder took place, which was registered as Case Crime No. 671 of 2015 under Sections 302 and 34 IPC, P.S. Bhopa, District Muzaffar Nagar. The ex-Pradhan of the Gaon Sabha, namely, Md. Ammar, who was doing pairvi on behalf of the complainant, was provided security by the State. Md. Ammar was murdered in another incident, which was registered as Case Crime No. 1636 of 2017 under Sections 307, 302 and 120B IPC, P.S. Kotwali Nagar, District Muzaffar Nagar. Thereafter, the present petitioner is doing pairvi in Case Crime No. 671 of 2015 and on account of death of Md. Ammar, he apprehends danger to his life and, as such, he approached this Court seeking the aforesaid relief.
In such a situation, it is directed that petitioner may make an application seeking security before the District Magistrate, Muzaffar Nagar in accordance with the provisions contained in the Government Order dated 09.05.2014 for the purpose within a period of three weeks from today with the further direction to the District Magistrate that, in case, such an application is moved, the same shall be forwarded to the District Level Committee, which shall take an appropriate decision thereon by a reasoned and speaking order after considering the threat perception within four weeks from the date of making of the application.
Writ petition, accordingly, stands disposed of.
