THESE WRIT PETITIONS ARE FILED UNDER ARTICLES 226 & 227 OF THE CONSTITUTION OF INDIA PRAYING TO QUASH THE NOTIFICATIONS AT ANENXURE-B DTD:7.4.2016 ISSUED BY THE R-2 ANNEXURE-C DTD:28.4.2016 ISSUED BY R-1 AND ANNEXURE-D ISSUED BY THE R-1 DTD:30.6.2016 IN SO FAR IT MAKES FURNISHING THE ADHAR NUMBER MANDATORY FOR ISSUE OF COUPONS TO DRAW FOOD GRAINS AND KEROSENE.
THESE WRIT PETITIONS COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP, THIS DAY, THE COURT MADE THE FOLLOWING:
O R D E R Sri.Praveen Kumar Raikote, learned counsel for the petitioners and Sri.V.Shivareddy, learned HCGP for the respondents.
2. The writ petitions are admitted for hearing. With the consent of the parties, the matter is heard finally.
3. In these petitions under Articles 226 and 227 of the Constitution of India, the petitioner has inter alia prayed for the following reliefs:
“(A) Issue a Writ of Certiorari and quash the notifications at Annexure-B dated 7-4-16 vide No.CFS/PD/IV/Jahirathu/1/2016-17 issued by the respondent No.2 Annexure-C dated 28-4-16 vide number CFS/PD/IV/Jahirathu/2/2016-17 issued by the respondent No.1 and Annexure-D issued by the respondent No.1 dated 30-6-16, in so far it makes furnishing the Adhaar Number mandatory for issue of coupons to draw food grains and kerosene.
(B). Any other Writ Order or Directions that this Hon’ble Court deems just in the circumstances of the case.”
4. When the matter was taken up for consideration today, learned counsel for the parties jointly submit that the controversy involved in these petitions is squarely covered by the decision rendered by the Hon’ble Supreme Court in the case of ‘JUSTICE K.S. PUTTASWAMY (RETD.) AND ANOTHER VS. UNION OF INDIA AND OTHERS’, 2018 (1) SCC 809.
In view of the aforesaid submission, the writ petitions are disposed of.
