1. By way of present application, filed under Section-439 of the Code of Criminal Procedure, 1973, the applicant has prayed to release him on regular bail in connection with C.R.No.I-72 of 2011 registered with Savarkundla (Rural) Police Station, Amreli for the offence under Sections-302 and 114 of the Indian Penal Code.
2. It is submitted by learned advocate for the applicant that as other accused are released on bail by this Court (Coram:R.R. Tripathi, J.) by order dated 18/05/2012 on the ground of parity, present accused may be released on bail.
3. On instruction, it is submitted by learned APP that earlier this Court has rejected the bail application on the ground that trial has commenced and six witnesses are examined. Now there is no change in the circumstances and fourteen witnesses are examined. Trial is in progress and next date is 19/07/2012. Present applicant is accused no.1.
4. In view of above, present application is rejected. Rule is discharged.
