Heard learned counsel for the applicants and learned A.G.A. for the State.
The present application under Section 482 Cr.P.C. has been filed for quashing the entire proceeding as well as NBW dated 19.9.2006 in case no. 134 of 2002 arising out of case crime no. 23 of 2000, U/s 3 of RP (UP) Act, P.S. Garhwa Road (RPF), Mandal Dhanbad pending in the concerned court below.
Learned AGA has opposed the application with the contention that the applicants were on bail, however as they could not appear on account of them gone out, NBW has been issued.
After hearing learned counsel for the parties and after perusing the averments made in the present application, no case for any interference has been made out. Accordingly, the prayer, as made above, is refused.
However, without expressing any opinion on the merits of the case, it is directed that in case the applicants appear and surrender before the courts below and apply for bail, their prayer for bail shall be considered and decided expeditiously on its own merits.
With the aforesaid direction, the application U/s 482 is disposed off finally.
