Heard learned counsel for the petitioner and perused the record.
Present petition has been filed with a prayer that the Court below i.e. Additional Civil Judge, (Junior Division) Fast Track Court, Room No. 16, Allahabad be directed to expedite the hearing and decide the Original Suit No. 297 of 2006 (Iqbal Husain Vs. Shamshad Husain & Others) within a time bound period.
In the facts and circumstances of the case, the present petition is finally disposed of with the direction to the Additional Civil Judge, (Junior Division) Fast Track Court, Room No. 16, Allahabad to expedite the hearing of the aforesaid case and decide the same on its own merit, in accordance with law, expeditiously preferably within a period of one year, provided there is no legal impediment and no unnecessary adjournments shall be granted to the parties.
With with aforesaid observations/directions, the present petition is finally disposed of.
